Yes, this is possible, but force majeure is also regulated by law, and it is not so simple to evade away from obligations. The declaration of emergency does not imply that circumstances of force majeure will automatically apply. The emergency must impact performance of a specific obligation or contract. Thus, if the coronavirus outbreak causes non-performance, it could be regarded as force majeure so that non-performance of the contract would be excused, and the liability of the obligor lifted (except for monetary obligations). Estonian law regards force majeure as a situation and circumstances which are beyond the control of the obligor and could not reasonably have been expected, taken into account, avoided or overcome. The general existence of a force majeure situation is not enough, but the event must impact the performance of a specific obligation or contract. Thus, if the coronavirus outbreak causes non-performance, it could be regarded as force majeure and thus non-performance of the contract would be excused and the liability of the obligor removed. If the obligation is monetary (e.g. payment of a sum of money), the situation requires more detailed analysis. Under Estonian law, the obligee may require performance of the obligation to pay the money regardless of force majeure. However, if force majeure prevents the other party from performing the obligation for which the payment is due, the party obligated to pay is entitled to withhold the payment. This means, in case of force majeure events (and pandemics and emergency state can be one of those) all cases of delays or inability to perform under contract have to be viewed case by case, and borrower has to provide information how the coronavirus outbreak causes non-performance. If a business will be able to prove force majeure, it will be hard to compensate accrued interest on delayed payments. In other cases you may expect compensation of each day of the delay. [size=34]Project closed and fully repaid [/size] One of the projects though got repaid month and a half ahead of its time. All investors received full repayment with outstanding interest accrued.  All withdraw requests were processed immediately. A mi también me han llamado hoy para lo mismo, acertando igual en el nombre , importe y dirección.

Otro mas. Me acaban de llamar tambien con los datos. Que me llamara para declarar en la audiencia nacional (glubs). Y que tenga la maxima docuemntacion que tengamos a mano...

Entre el fraude del BB en algunas plataformas más la estafa de otras....va a costar levantar cabeza...

Sea como fuere, no sé si será cierto o un intento de obtener datos. En mi caso, DNI y correo electrónico pues el móvil y el nombre ya lo tienen...Yo, mientras no pidan tarjeta de crédito o cuenta corriente tampoco desconfío mucho.

¿Cómo de grave puede ser que tengan esos datos de tratarse de algún tipo de engaño? Quizá el engaño venga después, no? Y esto solo sea una forma de ganarse nuestra confianza....

A mí también me han llamado y me han preguntado si quiero declarar, 50€ es la roncha según les ha comunicado el gobierno de letonia, les he dicho que sí ya que no hace falta abogado.

Es curioso , acabo de entrar en la web y los dos euros y pico que pedí hace 3 o 4 meses recuperar y que estaban en stand by , por el tema del grupo de acción, están desbloqueados .

Como bien decís, los datos los tenían claro, a excepción de mi móvil, que tenían un numero muy antiguo.

Al final el tema de declarar es voluntario, tampoco es que se pueda aportar mucho mas a la investigación, pero creo que ahora si que tiene mala pinta.

Le he comunicado que lo ultimo que yo sabia , es que un juez no había aceptado la Quiebra de la compañía, y mi interlocutor ni siquiera sabia este dato, lo cual no implica que a posteriori hayan sucedidos mas cosas.

De todas formas, por otro lado que estoy preguntando veo que las cosas no pintan bien.

Ná, rpeguntas sencillas....Lleva la documentación que tengas...Piden lo que tienes invertido, el código de los proyectos en los has invertido...en fin, lo típico

A mi tambien me ha citado policia judicial, unas preguntas sobre los proyectos, cuales eran, y aportar documentacion tanto de proyectos como todo lo que tuviera e incluso transferencias a las cuentas de ellos

Thank you for signing up through the Google Form for joining the legal action against Wisefund. A year has passed since the case was started and we are now preparing additional legal steps.
 
Introduction
For those of you who don't know me yet, my name is Roland Hes and I am the main organizer of the case against Wisefund. I am getting support from Guillermo (organizer of the Kuetzal, Envestio and Monethera cases) and Kurt (co-organizer of the Grupeer case). They will help in the background if necessary.
An SPV (special purpose vehicle) was established last year to which we can assign our claims: WSFND Action OÜ with registry code 16053576 at the Estonian chamber of commerce. Please see the attachment for an excerpt.
 
Same as for the Kuetzal, Envestio and Monethera cases, again for Wisefund we've partnered up with Magnusson law firm. The lawyers representing us in the case are Denis Piskunov (https://www.magnussonlaw.com/people/denis-piskunov/) and Jaanus Mägi (https://www.magnussonlaw.com/people/jaanus-magi/).
 
What has been done so far
In the previous funding round (september 2020), around 200 Wisefund victims joined and we managed to raise more than expected: around € 25.000.
With this money, we financed the submission of an extensive criminal report to the authorities and starting a bankruptcy case vs. Wisefund Capital OÜ in Estonia.
Thanks to our actions, prosecutors in both Estonia and Latvia have launched investigations into Wisefund's practices and these are still ongoing. At their request, many of us Wisefund victims have been called in by local police forces all over Europe to provide statements.
Unfortunately we have been less successful in regards to the bankruptcy case: even after an appeal, we did not manage to declare Wisefund bankrupt, even though we supplied clear evidence of fraud to the court.
Disappointingly, the circuit court agreed with the court of first instance, that the claim against Wisefund must be first resolved in action proceedings before moving ahead with bankruptcy proceedings. The ruling shows no desire to study the case and present analysis on key arguments and evidence pointing towards fraud.
As concluded by our lawyer Denis: 'It inevitably appears that our judicial system is not yet ready for dealing with investment fraud on an adequate basis.'
 
The way forward
We have recently received information that funds held in Wisefund's Hungarian entity, Wisefund Capital Kft (register number 01-09-344890), have been seized by the local authorities. Next to that, many of us made deposits to a bank account owned by this Hungarian entity. We also received information that Wisefund Capital Kft has been put into forced liquidation. If this would succeed, there would be no way anymore to get bankruptcy declared.
For these reasons we decided to start a bankruptcy petition against Wisefund Capital Kft.
Our aim is twofold:
- By having bankruptcy declared we could get insight into Wisefund Kft's bookkeeping: this is key evidence for us which helps us show misappropriation of investors' funds.
- If indeed any funds are seized by local authorities, we need to put a claim on them in order to prevent them going to the state, which is also an ongoing topic in the Envestio and Kuetzal cases.

Magnusson will not be charging a success fee. As the organizer, my proposal for remuneration if we are successful is 1% of the recovered funds, with a maximum of €3000.
 
Donation
Currently we have about €500k in claims on the waiting list. To reach our target of €20.000 and assuming 80% will participate, we ask for a contribution of 5% of your outstanding claim (total account value) at Wisefund, with a minimum of €25. This minimum is set because each participant regardless of claimed amount generates the same amount of administrative work on the organising side and at Magnusson's side.
 
In the interest of clarity we note that donations are conditional loans, meaning that by donating, the investor will support the lawsuits, but the SPV will only make repayments if we’ll manage to recover funds. The distribution of these funds is regulated in the AA (Assignment Agreement) and is proportional to the claimed amount.
 
To make the donation process easier, Magnusson has opened a custody bank account for us in the name of the SPV, so that all the participants can transfer their contribution directly to the SPV.

We have made preparations to open a new front against Wisefund. Wisefund used an agent Wisefund Capital Kft in Hungary to collect money from investors. We have obtained information from the Estonian prosecutors office stating that at least from its Hungarian bank account there are no transactions to majority of the borrowers portrayed on the platform. Wisefund Capital Kft may have investors' funds still on its bank account and that may be seized by the Hungarian authorities. However dependent on Hungarian law, they may direct it to the state's budget if victims do not appear before them with their claims. In addition, Wisefund Capital Kft has put into forced liquidation and the company may be deleted if no-one manages to interrupt the proceedings. Therefore it would be wise to file our investors' claims in Hungary to try to interrupt the liquidation and enforce our claims there.
 
Therefore, we have made preparations to engage an Hungarian law firm (Forgó, Damjanovic & Partners Law Firm) to represent the investors. Our goals in Hungary are to obtain information on Wisefund Capital Kft's assets, to get access to its bank accounts and bookkeeping and to understand what happened with the money. Secondly, we hope to gather further evidence on the misappropriation of funds that would help us to bring clams against he platform and people behind wisefund. Lastly, we hope to satisfy investors' claims from Wisefund Capital Kft's assets and to recover any money Wisefund Capital Kft has transferred to so-called borrowers. To start our efforts in Hungary, we need however additional "donations" to fund the lawsuits.

Qué opináis¿???

Primeras impresiones:

1- posiblemente el bloqueo de las cuentas en Hungría tienen que ver con la investigación de la policía de Estonia.
2- las autoridades de cualquier pais , son las primeras en cobrar ( después de los trabajadores) por los impuestos, etc, y después los gastos del administrador concursal y tasas judiciales se llevan otro buen pico, es por ello que no es que incauten , sino que cubren los gastos de los procesos.
3- si sobra algo para los inversores.
4-he buscado en el registro concursal de Hungría alguna novedad, 0 patatero de momento y tampoco en Estonia.
5-Si la investigación policial sigue su curso, y al final hay fraude se instara la Quiebra si o si, a partir de ahi el proceso puede ser largo pero podríamos recuperar via IRPF, parte de la perdida.
6-Wisefund ha sacado un nuevo proyecto en Octubre , mandan webs, pero no ha financiado ni un euro, aun asi sigue cumpliendo con las declaraciones de IVA, y resto legales.
7-Entiendo que no pagan ni pagaran(suponiendo 100% honradez por parte de la plataforma)  mientras no se resuelva la investigación policial, en uno u otro sentido.

Conclusión, los abogados también quieren su parte en uno u otro sentido, pero para mi no tiene sentido actuar mientras haya diligencias abiertas.

Mi miedo es que e dinero ese que hay en Hungría vaya para los que participen en la iniciativa legal y se lo repartan entre ellos solamente....Me ha parecido entender que la idea no es buscar la quiebra si no pillar ese dinero y reaprtirlo entre los que participen...

Eso teóricamente no funciona así, primero hay que demostrar que ese dinero pertenece a Wisefund ( Estonia) , y puede que asi sea, por ejemplo de los dividendos que se hayan estado cobrando de los prestamos y que no se han repartido o de algun proyecto devuelto.

Si es así y se puede demostrar ( es para lo único que vale la demanda en Hungria) y la demanda en Estonia declara la quiebra , el administrador de la quiebra podría solicitar el retorno de esa cantidad a Estonia ( échale unos meses o un par de años) y después entraría en la liquidación de Estonia, es decir, primero el estado, después los gastos de admin y tasas y si queda algo para la liquidación proporcional de los acreedores.
